Legal notice

This legal notice concerns the scopemy.city service: the citizen observatory available at scopemy.city, its WhatsApp reporting channel and the platform offered to public authorities. The former address fixmy.city redirects to scopemy.city.

Model and independence

scopemy.city comprises two offerings:

• the citizen observatory, free of charge for the population, free of advertising and independent of the authorities;
• the platform for public authorities, a white-label version sold on a subscription basis to municipalities, cantons, groupings of municipalities and organisations (property management agencies, campuses). See the For public authorities page.

Revenue from the platform funds the operation of the service. It gives no client public authority any say over the publication of reports on the observatory. We do not sell personal data and do not display advertising.

Data protection

For the citizen observatory, Help4Housing Sàrl is the controller within the meaning of the Federal Act on Data Protection (FADP) and, where it applies, of the General Data Protection Regulation (GDPR). On an instance provided to a public authority, that public authority is the controller and we act as processor.

Hosting

Website and database: Tizoo SA (AlpHosting), Switzerland, www.tizoo.ch. The application's data is stored in Switzerland.
WhatsApp messaging: Meta Platforms Ireland Limited, Dublin, Ireland, with processing in the United States by Meta Platforms, Inc.

The other service providers (e-mail delivery, base maps, geocoding, optional channels) are listed on the Processors page.

The instances of client public authorities are served at their own address (a subdomain of scopemy.city or the public authority's own domain). Each one publishes its own legal notice and privacy policy; the public authority is the publisher of the website and the controller.

Intellectual property

The scopemy.city trade mark, the logo, the visual identity, the editorial texts and the code of the service belong to Help4Housing Sàrl or to third parties that have granted it the right to use them. Any reproduction without written authorisation is prohibited.

The photos and texts submitted by users remain their property. They are subject to a limited licence described in the general terms of use.

Open data

Published reports are made available under the CC BY 4.0 licence (Open data page), with the attribution "scopemy.city and citizen contributors". The terms of use of the API and the widget are set out in Article 9 of the general terms of use.

Reporting content

To report content that you consider unlawful, or to challenge a moderation decision, follow the procedure described in Article 7 of the general terms of use, by writing to contact@scopemy.city.

Liability

scopemy.city is neither an official public service nor an emergency channel. In an emergency, call 112, 117 (police), 118 (fire brigade) or 144 (ambulance). The liability rules are set out in the general terms of use.

Governing law

This legal notice is governed by Swiss law. The rules on jurisdiction are set out in the general terms of use.
